These terms are an agreement between you and Qube, LLC (“Qube,” “we”) about Cat Got Your Tricks? (“the game”): the card game at cats.qubesoftware.com, our apps for iPhone, iPad, and Android when they are available, and the online service that runs games between devices. By playing, you agree to these terms and to the Privacy Policy. If you don't agree, please don't play.
1. Who can play
Cat Got Your Tricks? is a family game for everyone. If you are under the age of majority where you live, a parent or guardian should read these terms with you and agree to them for you. Parents and guardians are responsible for how their children use the game, including who they invite to online games.
2. Your license to play
We give you a personal, non-exclusive, non-transferable, revocable license to play the game for your own non-commercial entertainment, on devices you own or control, as long as you follow these terms. The game is free to play. You may not:
- copy, sell, rent, sublicense, or redistribute the game or any part of it;
- reverse engineer, decompile, or modify the game, except where the law allows it despite this limit;
- remove or change any copyright, trademark, or other notice in the game; or use the game, its name, or its art to make or market another product.
3. Playing online fairly
Online games are private: only people with a game's code can join it. You are responsible for who you share codes with. When you play online, please:
- choose a name that isn't offensive, hateful, sexual, or harassing, and doesn't pretend to be someone else;
- avoid using your full real name or anyone else's personal information;
- not cheat, exploit bugs, use automated tools or scripts, or try to see cards you aren't meant to see;
- not interfere with the service: no flooding it with requests, probing it for weaknesses, or getting around its limits; and
- follow the law where you live.
A game's host can remove players from the lobby before the game starts. We may remove a name, end a game, or block access to online play, without notice, to stop behavior that breaks these terms or puts other players or the service at risk. To report a problem with another player, see Support.
4. Your name and other things you enter
The only things you type into the game are player names. You keep whatever rights you have in them, and you give us permission to store them and show them to the other players in your games, only as needed to run the game and for as long as the Privacy Policy describes.
5. Our game
The game, including its name, characters, artwork, music, sounds, text, and software, is owned by Qube, LLC or our licensors and is protected by copyright, trademark, and other laws. These terms don't give you any rights in it beyond the license above. The fonts in the game are used under the SIL Open Font License.
6. Optional purchases
The game is free, and everything in it today is free. If we later offer optional purchases, such as extra card designs or themes, we will show you the price and what you get before you buy. Purchases made through the App Store or Google Play are sold and processed by Apple or Google under their terms, and refund requests are handled by them.
7. Changes and availability
We are always improving the game, so features may change, be added, or be removed. We may update the game or the service at any time, and some updates may be needed to keep playing online. We try hard to keep online play running, but we can't promise it will always be available, uninterrupted, or free of errors. Online games are deleted on the schedule in the Privacy Policy. We may stop offering the game or online play at any time.
8. No warranty
The game is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. Some places don't allow these exclusions, so some of them may not apply to you.
9. Limit of liability
To the fullest extent the law allows, Qube, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, scores, or games, arising from or related to the game. Our total liability for any claim about the game is limited to the greater of the amount you paid us for the game in the 12 months before the claim, or US$50. Nothing in these terms limits liability that cannot be limited by law.
10. Ending this agreement
You can stop playing at any time and delete the game's data from your device, as described in the Privacy Policy. If you break these terms, your license to play ends, and we may block your access to online play. Sections 4 to 9 and 11 to 13 continue after this agreement ends.
11. Governing law and disputes
These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules. If you have a concern, please email us first; most problems can be sorted out quickly. Any dispute that can't be resolved informally will be decided in the state or federal courts located in Utah, and you and Qube agree to their jurisdiction, except that either of us may bring a claim in small-claims court. If you live in a country whose consumer laws give you the right to bring claims in your local courts, or protections that can't be waived, these terms don't take those rights away.
12. Apple App Store
If you got the game from Apple's App Store, these terms also include the following:
- These terms are between you and Qube, LLC only, not Apple. Qube, not Apple, is solely responsible for the game and its content.
- Your license is to use the game on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, which include use by other accounts in your purchaser's Family Sharing group.
- Qube is solely responsible for maintenance and support of the game. Apple has no obligation to provide any maintenance or support.
- If the game fails to conform to any warranty that applies and hasn't been effectively disclaimed, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for the game. To the maximum extent the law allows, Apple has no other warranty obligation for the game. Qube is responsible for any other claims, losses, liabilities, damages, costs, or expenses caused by a failure to conform to a warranty, to the extent not effectively disclaimed.
- Qube, not Apple, is responsible for addressing any claims by you or a third party relating to the game or your possession and use of it, including product liability claims, claims that the game fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
- If a third party claims that the game or your possession and use of it infringes their intellectual property rights, Qube, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use the game.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and will be deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.

13. Google Play
If you got the game from Google Play, Google Play's Terms of Service also apply to your use of Google Play, and Google handles any purchases and refund requests. These terms are between you and Qube, LLC only, and Qube, not Google, is responsible for the game.
Changes to these terms
We may update these terms as the game changes. When we do, we'll change the effective date above, and for important changes we'll give notice in the game or on this page before they take effect. If you keep playing after a change takes effect, you accept the updated terms.
